General Terms and Conditions of Sale

Order information

You can order from Bischofberger Gardening via the Internet shop, e-mail or directly in the shop. You will receive a confirmation for each order

1 Validity of the Terms

All services and deliveries from us are subject exclusively to the terms outlined below, which the customer explicitly accepts as part of the contract at the time of placing the order.

2 Conclusion of the Contract

The contract is considered concluded when we confirm in writing the acceptance of the received order.

3 Prices and VAT

Our prices are in CHF and are retail prices, including 8.1% VAT or 2.6% VAT where applicable.

For orders from other European countries, Swiss VAT is always charged.

Additionally, shipping costs and, if applicable, cash-on-delivery fees charged by the courier will be added. Shipping costs are the responsibility of the recipient. Price and product changes are reserved.

4 Ordered Products

Customers ordering products from us will first receive an offer. This offer is generally valid for 10 days. Within this period, the customer can decide whether to place the order.

4.1 Delivery Time for Ordered Products

The delivery time for products we order for a customer is generally 5-10 days from confirmation of the offer and receipt of the advance payment.

4.2 Deadline for Picking Up Ordered Products

The deadline for picking up ordered products is 7 working days. If the products are not picked up within this period, a storage fee of 10% of the order value will be charged for every 7 days thereafter.

4.3 Payment for Ordered Products

50% of the order value must be paid upon confirmation of the offer. The remaining 50% is due when the goods are collected.

If delivery is agreed upon, the amount must be transferred within 10 days.

4.4 Uncollected Ordered Goods

If the goods are not collected within 7 days, storage fees (see section 4.2) will be charged.

If the goods are not collected within 7 days, we will proceed with debt collection.

A confirmed offer is a binding purchase contract and obligates the customer to pay for the products!

4.5 Reminder and Debt Collection Fees

If the products are not paid for by the agreed date (normally within 14 days), we will charge a reminder fee of CHF 50.00 for our additional work, costs incurred, and interest.

If the products remain unpaid 14 days after the reminder, debt collection procedures will be initiated. A flat fee of CHF 200.00 will be charged for debt recovery.

If you are experiencing financial difficulties, please contact us. It is always possible to discuss this with us. But those who do not communicate will be held responsible for themselves.

4.6 Shipping of Products

The shipping of products is handled by a shipping partner. The customer can choose the most suitable shipping partner during the order process. The actual transport time depends on the shipping partner.

Bischofberger Gardening cannot be held responsible for delays caused by the shipping partners.

Post:

  • A Post generally 1-2 days
  • B Post generally 2-3 days

DPD:

  • Typically 3-5 days

Warning: Even the Post makes errors in 2-3% of cases during shipping, which may also occur with our shipment volume.

6 Inspection, Acceptance, Commissioning

The customer must immediately inspect the delivery and notify us of any defects for which we are responsible within 3 days of receipt in writing.

If not, the delivery is considered approved.

7 Shipping

Any special requests regarding shipping and insurance must be communicated promptly. Shipments can be made by parcel service, TNT, or mail, as agreed. If products are too heavy (e.g., soil), we reserve the right to ship the goods by truck (freight shipping).

8 Deliveries

Deliveries are usually made within 3-5 working days from receipt of payment. If part of the order is not available in stock, delivery may be arranged accordingly.

Bischofberger Gardening may make partial deliveries. In this case, the additional shipping costs for the extra packages will be borne by us.

9 Partial Deliveries

Partial deliveries are free of charge! If the items are not available for the agreed delivery date, we reserve the right to make partial deliveries or delay the delivery. We disclaim any responsibility for damages due to delays or failure to deliver.

10 Consignment Stock

It is possible that Bischofberger Gardening sets up a consignment stock at your location. To do this, you need to fill out this form to request consignment stock.

Requests can be rejected without explanation.

10.1 Payment for Consignment Stock

The products in consignment stock are invoiced monthly (at the end of the month). This means that the customer sends an unsolicited list of all the products they have sold.

They can then choose whether to receive new products or simply pay for the old ones.

The payment must be made immediately. Bischofberger Gardening will issue the invoice and grant a payment term of 5 days.

If the invoice remains unpaid after the due date, reminder fees may be charged. Additionally, Bischofberger Gardening reserves the right to close the entire consignment stock. The customer has two options:

  • Return all products within the specified time (usually 5 days).
  • Or the entire consignment stock will be invoiced.

10.2 Breach of Contract and Penalties

Anyone who breaches the contract or fails to meet the above terms will be subject to a penalty. It depends on the value of the consignment stock. Typically, it ranges from 3% to 5%, but it can go up to 10%.

Additionally, Bischofberger Gardening reserves the right to charge reminder and debt collection fees. It is also possible that the goods will be retrieved and all incurred costs will be charged to the customer.

11 Seeds

Our seeds may only be used for private or non-agricultural commercial purposes (especially in indoor setups that exclude natural light and do not belong to a farm or gardening business).

Since January 1, 2020, there are no restrictions for varieties containing less than 1% THC (the variety catalog has been abolished).

All our seeds are tested and free for commercial use! We are happy to support our producers in choosing the right variety. For many varieties, we also have hemp flower samples in stock.

11.1 Germination Warranty

We offer a 90% germination warranty on all seeds purchased from our store! If the germination rate is lower, please contact us here.

Please follow our germination guide. Only if you follow the guide can we offer the warranty.

11.2 Free Seeds with Every Order

With every seed pack purchased, we provide a free seed. Typically, we will provide the same variety ordered, if possible. However, it may happen that we do not have all seeds in stock. In that case, you will receive a different seed.

No claims are accepted for the free seeds. No refunds or replacements are possible. Additionally, the "Germination Warranty" does not apply to the free seeds.

12 Warranty

Our warranty is limited to the return of the defective item to the manufacturer.

Other customer rights, such as damage compensation or contract termination, are excluded.

Damage caused by normal wear and tear, poor maintenance, failure to follow the instructions for use, excessive stress, or use of unsuitable consumables is not covered by the warranty. The warranty period is normally 12 months from the invoice date. For devices that operate continuously or nearly continuously, the warranty is limited to 6 months.

The warranty expires if changes or repairs are made by anyone other than us, unless explicitly authorized. The warranty will also expire if the customer does not take appropriate measures after damage occurs. The customer is required to minimize the damage. All warranty claims are only carried out upon presentation of proof of purchase.

Items sent in for warranty or return are inspected by us to verify the defect or damage. If the defect is confirmed, the goods will be repaired or replaced and sent back to the customer free of charge. If it is determined that the defect is not justified or that the goods function correctly, the labor costs and expenses for reimbursement will be charged to the customer.

13 Liability

We commit to delivering in accordance with the contract and fulfilling our warranty obligations. Any further liability towards the customer for damages is excluded.

14 Instructions for Use, Hazard Warnings, and Legal Provisions

The customer agrees to read the instructions for use, hazard warnings from the respective manufacturers, and comply with the applicable legal provisions when handling the products sold.

15 Right of Withdrawal, Cancellation

The customer has no right to withdraw from the purchase. Exceptions may be granted by Bischofberger Gardening. Courtesy solutions are possible.

If damaged or worn goods are returned without or with unusable original packaging for resale, the legally permitted amount will be deducted. You must pay a reasonable amount for the use, including compensation for the associated reduction in the market value. Please include a sheet with your name, address, invoice number, full bank details, and reason for return.

Shipping costs are non-refundable.

For order cancellations, we charge a processing fee of CHF 20.- (restocking / refund) plus 10% of the purchase amount as compensation for processing costs depending on the effort, and the shipping costs. For cash-on-delivery shipments, the cash-on-delivery fees and shipping costs will be charged.

WARNING! In every case, we require 10% of the order value after completing the order. Even if no advance payment is made. Additionally, a storage fee of CHF 20.00 will be charged. Please think carefully before you click "Order".

16 General Law

Errors, typographical errors, price changes, and product changes are reserved. All product, brand, and company names are the property of their respective owners. All rights reserved.

The photographic material displayed on Bischofberger-Gardening.ch is subject to the copyright of the respective photographers or image owners. Product images are symbolic. The actual product may differ in appearance.

Bischofberger-Gardening does not assume any liability for missing, incomplete, or incorrect copyright information. Content and design of the website are protected by copyright. Unauthorized reproduction or distribution of individual content or entire pages is not permitted. Reproduction of the pages or their contents requires prior written consent from Bischofberger-Gardening. Displaying this website in foreign frames is only permitted with written permission.

17 Jurisdiction and Applicable Law

The contractual relationship between us and our customers is governed by Swiss law.
