1. Scope of Terms
All deliveries and services provided by our company are subject exclusively to the following terms and conditions, provided the customer acknowledges them as an integral part of the contract. Deviating conditions require our express written confirmation.
2. Conclusion of Contract
The contract is deemed concluded when we have confirmed its acceptance in writing after receiving an order.
3. Prices and VAT
All prices stated on the seller's website are in Swiss Francs. The prices specified by the seller are total prices. Value-added tax (VAT) is not shown, as the seller falls under the small business regulation.
For deliveries to other countries, customs duties and other fees may apply, which are to be borne by the customer.
Obvious pricing errors and mistakes in price indications remain reserved. Should a product be incorrectly marked with a wrong price by mistake, we are entitled to contest the contract. In this case, the customer will be informed immediately, and any payments already made will be fully refunded.

4. Ordered Goods
You can order all products displayed in the online shop directly online. This offer is usually valid for 10 days. Should an item be out of stock, we will inform you immediately.

As a rule, orders are dispatched within 1–3 days after receipt of payment, provided the goods are in stock. If the goods are not in stock, the delivery time is usually 7 days (depending on stock availability).
4.2 Sold-out Items / Incorrect Delivery:
Should items no longer be available at the time of your order, we will inform you immediately and refund any amounts already paid.

The sale of certain products, especially hemp seeds, is subject to a minimum age. Orders from minors will be canceled and any amounts already paid will be refunded.
4.4 Cancellation by the Customer:
Orders in the online shop are binding. There is no right to cancellation or withdrawal. If, exceptionally and out of pure goodwill, Bischofberger Gardening accepts a cancellation request from the customer, a processing fee may apply. In this case, payments already made will be refunded exclusively in the form of a voucher for the Bischofberger Gardening online shop. Cash refunds are excluded. We charge a cancellation fee of 10% of the purchase price, which will be retained for any work performed.

6. Inspection, Acceptance, Commissioning
The customer must inspect the delivery immediately upon receipt and report any defects for which we are responsible to us in writing within 3 days of receipt.
Failure to do so will result in the delivery being deemed accepted.

7. Transport & Liability
We pack all goods with the utmost care and hand them over exclusively to recognized transport service providers (Swiss Post, freight forwarders, etc.), where each shipment is insured against loss and damage.
Liability for transport damage lies with the respective transport service provider. The customer is obliged to check the goods for completeness and integrity upon receipt and to report transport damage or missing/damaged goods to us within 3 days of receipt, preferably with photos of the damage.
Bischofberger Gardening is liable for proper packaging. We assume responsibility for damage caused by improper packaging. For damage occurring during transport, the respective carrier or Swiss Post is liable.
The goods are deemed delivered as soon as they have been handed over to the customer completely and undamaged.

9. Subsequent Deliveries
Subsequent deliveries will be made if articles are not available at different times. Subsequent deliveries, as well as partial deliveries or collections by appointment, are possible; additional costs are generally not incurred for this.

10. Defects and Returns
Complaints regarding incomplete or incorrect delivery or defects must be reported to us in writing immediately, but no later than within 3 days after receipt of the goods.
Returns will only be accepted after prior consultation and in unused, originally packaged condition.
For returns that are not due to an error on our part, we may charge a processing fee of 10% of the value of the goods (but at least 10 CHF).

In principle, there is no right to return or withdraw the order after dispatch.

For electronic items, we grant a warranty of 24 months (2 years) from receipt of the goods, unless expressly stated otherwise.
In the event of justified defects or functional deficiencies, we will, at our discretion, provide a repair, exchange, or refund.

Bischofberger Gardening does not carry out its own repairs. The processing time depends on the respective manufacturer. There is no entitlement to a replacement device or an immediate replacement delivery during the repair period.
In the case of a justified complaint, we will cover the costs for the return shipment and replacement delivery. Unjustified returns will be sent back at the customer's expense.

14. Changes to the GTC
Bischofberger Gardening reserves the right to change these General Terms and Conditions at any time. The version valid at the time of the order shall be applicable.
15. Severability Clause
Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the permissible regulation that comes closest to the economic purpose of the invalid provision shall apply.
16. Applicable Law
Swiss law applies exclusively. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The provider assumes no guarantee for the correctness, completeness, and topicality of the content on this website. No liability is assumed for damages resulting from the use of the information provided – as far as legally permissible and in the absence of intentional breach of duty.
